    Deposition and Second Modification
My question involves a child custody case from the State of: Missouri

During my deposition this week I feel her lawyer realized that I was telling the truth regarding some important factors with this modifaction. Her lawyer kept asking for breaks where she would take my ex wife away to discuss I think, strategy. I guess I just dont understand why her lawyer would request more time if they felt they had me by the "you know what" then to drag this on. I want to move on from this, and my lawyer has tried to speed up the process but because her lawyer has not been to court proceedings not returned phone calls we are where were at. My lawyer an I have been totally confused to what my ex wants. There is no question that the boys are happy with myself, my wife or her son. They infact love them. I'm sure the guardian ad litem will be able to see thru this crap as well. I think I know why she is doing this. This last year she tried to reconciled "yes I have the email and text msgs". I think shes doing this because shes mad at me. The deposition was mostly about te negative or "bad" things I did before the divorce. Like: bad check, one spanking, a fight between my ex and myself, where we both went to jail, {this came out during the depo and I believe her lawyer didn't know. Her lawyer asked for a break.} and questions regarding me taking fmla because of some sexual misconduct between our boys. {i did seek help for them as well as told her about the "incident" regaarding them. While writing this I've kinda forgotten my actual question and sorry if this paragraph is all over the place. Everyone needs closer here and why is her lawyer dragging this along. side note: I was given 50\50 custody excange children every other week.

    Confused

If you don't have a lawyer, get a lawyer.

If you have an actual question, try asking it.

I have a lawyer. Again, just had my deposition, how much of a deposition is important. My lawyer says anything since the last modification decree can be brought up. Is this true?

When you are arguing that there has been a change of circumstances, anything that has occurred since the last court ruling can be evidence of a change of circumstances.
