    Emancipation by marriage in Illinois
Hello. I asked a while back about emanicipation in Illinois. My daughter wants to be emancipated. I gave her a copy of the statutes that you gave me. To begin the process she has to file the paperwork with an $80 filing fee. I told her I am not going to pay it. She wants to do it, then she finds the money......Long story short: she seems to think that if she gets married she can be emancipated. She is 16 yrs old. Please give me the "Low-down" on the whole emancipation by marriage thing so I can have some facts.

    Thank you very much!

She will need your consent to get married so if you don't agree to it she cannot get married and therefore will not be emancipated.

In IL if you are 16 or 17 years of age, you will have to provide a copy of your birth certificate along with some other sort of identification showing your date of birth. You will also need to have the sworn consent from each parent, each legal guardian or a judge - in person - before the county clerk at the time of application. If your parent is deceased, you will need to show a death certificate or proof of guardianship, or a court order waiving consent. A legal guardian will also need to show a certified copy of the guardianship papers. If you are under 16 years of age, you cannot get married.
