This is where I think the confusion is coming in a little bit. The court orders DNA testing to establish or disestablish paternity. Your paternity is no longer an issue, because of the adoption. So why would the court order DNA testing when a) the child has a legal father and b) you aren't the biological father? It serves no purpose- and remember, this is about the child. Not the parents.
in red: if a dna test is no longer an issue, then i am not the Bio dad, then why should I have to pay..
I DID ask for a paternity test.. over and over again.. to her an the courts, why do you keep saying I did not?
yes there WAS a court order in the past, from apr 06-nov 07 up to the adoption.... that case was closed.. I have documents of that,,, my ex doesn;t have the paper work from the case, the courts tried to contact her... all letters were returned to sender, they cannot find her..
I have no contact with her, so I would not know how to get a hold of her..
they said she needed to go to the court house to pick up the documents of OUR CLOSED case, included in there is the child support...
the judge would have never let me leave the country or get a passport while under court orders of child support that was i arrears, which it was during that time...

I have never paid any child support, only the first month while under orders to pay, but when i found out that it was not mine i REQUESTED paternity from the ex and lawyers, they said she didnt have to produce any....
so when i hear your side, it is a flip flop of what i heard for 7 years....
not your fault... but it does concern me..
we are hopig that when the ex gets the papers from the court as well as DCSS they will drop the case, as it is CLOSED..... the case number includes, marital assets, credit cards, cars, child support, bench warrant, and adoption... I had to prove that that happened to teh judge..

Because you were the child's LEGAL father for that period of time.

Your arrears have to be over $2500 (from memory) in order for the passport to be withheld/revoked.

Then you likely WILL owe the support.

I honestly don't think you really understood what was happening. Be that as it may, if there are arrears owed to Mom she does have the right to collect even IF you're no longer the child's legal father and even IF you're not the biological father.

Afterthought: The case being closed simply means that the State would no longer push for collection. It does NOT mean that the arrears have gone away.

so then why would the judge let me off during the time of owing arrears child support and grant me the right me the right to leave the country?

Exactly - there was a court order. Mom evidently did NOT waive the arrears. Hence she can still try to collect.
(The court cannot waive the arrears on her behalf)

(Nobody can stop you from leaving the country, incidentally - well, short of being on probation/similar restrictions)
