    Withdrawal of Amicus Attorney
    My question involves a child custody case from the State of: Texas

    Can you request an Amicus Attorney to be withdrawn from your case?

    The amicus attorney was appointed by the Court. From the beginning she has been biased. She has already requested about $4,000.00 since July to present. She charges for any little thing such as text messages between my ex and her, emails, conversations with her staff, etc. I cannot pay her one more cent if she requests additional attorney fees. She already told me what her recommedation to the Court is going to be... she's not going to recommend the child to be with me since the child has been with the other parent. The Amicus Attorney doesn't see that the other parent has coached my son, lives in a section 8 apartment, lives with a person that is married to someone else, my son has some sort of skin infection that his father hasn't taken him to the doctor for, has missed my son's dentist appointments, has never had my son in a car seat and other factors that she does not put into consideration.

    That is a pretty typical reason. There's nothing wrong with living in section 8 housing. As far as the other things go, it usually takes much, much more than that to change a child's living situation. The courts know children need stability.

    You can ask for anything you want. Whether or not the judge grants your motion will depend upon the law and facts you present.
