Wisconsin Teen Needs Emancipation Help
Hello,
I am from Wisconsin, and I would like to be emancipated. I am having a plethora of difficulties with my mother, who has been told by nonexperts and expert alike that she has BPD and is also bipolar. I have been told by third parties in the matter that from what they have heard, she is emotionally abusive to me. I feel myself slipping farther into an emotional hole each day, and being the self-motivated person I am, I would like to do something about it. I need legal help in this matter.
I would be able to be self sufficient, without a doubt. I am known to everybody as a teen who acts like an adult. I can work out a business deal better than most adults i know, I am a part-time co-manager of a local secondhand and variety shop (basically a pawn shop without the pawn..same clientele), and I can profit from just about anything. In addition to my job in lower management, I also run a small computer enterprise ont he side. I am set to graduate high school via an accelerated online program within 6 months and plan to take college courses online as well. I am 15 now, and am looking to be emancipated by the time I obtain my driver's license (which will be shortly after I turn 16).
I have a decent amount of money saved up and already have a late model, dependable vehicle that is paid for. I have a very good budget worked out, and I believe that I can convince anybody, be it a judge, social worker, etc. that I would be able to support myself. I have tried other methods to get out of this mess with my mother, but this seems like my only out because I refuse my so-called "father" or foster care. My "father" may as well be called a sperm-donor because of his lack of involvement in my life since he wreaked financial havoc and left myself and my mother when I was 5. I refuse foster care because from the accounts I have of that, it is no better. I would be much better off supporting myself and starting my life as a full-fledged adult.

I would suggest that you talk with your school counselor about the problems you are having.

Like i said before, happytrails, I go to school online. That would mean that I don't have a school counselor. Problem is, when I did go to school, I talked to the counselor, and my mother almost got me in the foster home system. Counselors=the system. Just like cops. I appreciate you trying to help, but I am not just an angry teen. I understand that I do not deserve what I am going through, and I am ready to begin my life as an adult to get away from that. I have plans so I can still continue my education, even through college. All I need is some solid legal advice on how to go about this in Wisconsin, or have I come to the wrong place? Should I call a local lawyer?

You indicated in various other threads that you're calling a lawyer today. Please share what you learn, particularly if there are emancipation options beyond what are reflected in the case law and statute.

Yes, aaron, I will be calling a local lawyer today. I will share whatever I learn in this thread. As for the "various other threads" I was trying to find a few other teens in my situation, hoping that I could help them with the information that I receive.

Sorry, I did miss the part where you posted, "I am set to graduate high school via an accelerated online program ...."
Some states are very clear (in their statutes) on the qualifications and the procedure on how to achieve emancipation, however, Wisconsin is not one of them. (We can only go by what your statutes state or any case law that has shown that this has been done.)
Even in those states that have emancipation laws, it is very rare and hard to achieve (especially if the parents are not in support of it).
