Late Rental Refund
My question involves landlord-tenant law in the State of: VA
I moved out of my 24 month lease at the 12 month period because I received orders to change my duty station since I am in the military. I submitted my notice 90 days in advance of the time I wanted to end my lease. My lease ending date at this point was 31 August which was agreed upon by the landlord. I actually moved out on 23 August after the landlord did the walk-through and I handed over the keys. The landlord did the walk-through on 23 August because she had a new tenant moving in on 24 August. I received my entire security deposit back on 23 August and she agreed to pay me the rental refund for the last 9 days of August since there was a new tenant. She explained to me that she only issues checks on the 10th of the month for rental refunds. So 10 Sept came and here excuse of why I did not receive a rental refund check in the mail was because she is converting her software for her business so she will issue the next checks on 10 October. It took me until 26 September to discover the software issue because she never said anything. I had to keep calling her office to find out why I did not receive a check in the mail. I offered to come by her office and get a cashiers check, money order or cash. At what point do I say "enough" and file a claim in small claims court or do I wait until 10 October and see if she issues a check?

If you sue, you're going to be waiting a lot longer than October 10 to resolve your case, so for now if it were me I would wait.
