Sex Offender Registration and Tiers
My question involves criminal law for the state of: Virginia
My ex husband was convicted of sexual assault (all misdemeanors) in March of 2009. He served 8 months in a county jail and was released in November of 2009. Since then, he has been on parole and/or probation. His probation officer has told him that he is considering releasing my ex from probation early next year. My ex has done all that he has been asked to do, such as attend sex offenders' classes, etc. He has not been in any additional trouble. So, here are my questions:
1) Does Virginia have the tier system in place for sex offenders? I know some states do, but not if Virginia does.
2) How can he figure out which tier his convictions fall on?
3) Is it ever possible for him to get off the registry?

Virginia doesn't have "tiers" to be exact, but they do characterize sex offenses as to whether the offender is EVER eligible for relief from the registration requirements.
The minimum time before you can apply is 15 years. Some crimes are not eligible for 25 years. Sexually violent offenses, multiple offenses, and murder bar you from ever making that application.
I suspect he's never getting off the registry.
The feds do define Tiers. SONRA requires him to stay on for 15 years even on Tier I.

Thank you for your help. I was hoping he could get off the registry sometime because he is having so much trouble finding work, but he needs work now so even if he could off, it wouldn't be for many years.
Do you know where online I can go to find a list of the Tiers and the convictions under each tier?
Do you suspect that he will never get off the registry because the convictions are sexual battery or because there are many convictions? There was only one victim and the "relationship" that he had with her lasted 5 months thus resulting in many charges. His victim was a 16 year old student and he was her teacher.
