Falsely Accused and then Convicted of Child Molestation in Georgia Over 10 Years Ago
My question involves criminal records for the state of: Georgia
I was falsely accused and then convicted of child molestation in Georgia just south of Atlanta. In a small town with a small town mentality. At the time my stepson ( age 15 ) was in the car with me when this was alleged to have happened. He even testified in court that he was in the car when the little girl said it happened! I was accused of exposing myself to her and asked her directions. There is only one way in and one way out of the subdivision. All of this while I was cooking at home some pasta that takes 11 min to cook. I was back at my house ( per my ex-wife ) before the timer went off. The arresting officer even stated that there was NO way I could have stopped and talked with anyone and made it back in that amount of time. They STILL found me guilty because of what the Prosecutor said and I quote " Let's make an example of out this man" ( pointing at me ) as he said to the jury, "That we do not want this in our town!" They did NOT care if I did it or not... they wanted to send a message to anyone and everyone. I followed all of the rules. I never did one day of jail time because the judge KNEW I didn't do this! He didn't overrule because it was coming up on election time and it wouldn't have been politically correct to do. I did 10 years of Probation and always registered whenever I moved like I was supposed to. It has cost me jobs... high paying jobs! It has caused my son to get bullied at school! My wife to loose friends! People read the charge and make up their own minds of what happened without asking me. When we moved in to our current HOA subdivision, we met with the president of the HOA and explained everything to him and he was ok with it. I have NEVER had any other kind of trouble and never will! What can I do to restore my rights to vote? To own a firearm to protect my family? To live a normal life? Please help....

Your recourse would have been to appeal the decision after trial. You should not need a firearm to protect your family. Voting is highly over-rated given the choices of candidates we seem to have available.

How long has it been since you were discharged from probation? You can apply to have your civil rights restored after 2 years and your firearms rights after 5. There is no guarantee that they will grant your request but you won't know without asking. Understand though that regaining firearms rights in GA does not necessarily restore them at the Federal level...which could cause problems. There is a process for regaining your Federal firearms rights but it is laborious and not funded so getting it done could take a while.
