Fired After Phone Call from Former Employer
:confused: My question involves labor and employment law for the state of: Alaska
After arriving at work today, I was informed by my employer that they had received a call from my former employer telling them that I was under investigation by the State Troopers for narcotics theft. Then apparently State Licensing had also called saying the same thing. I was never "under investigation" until I informed Licensing as well as the Nursing board that I had been instructed by the Administrator/Nurse at my previous job to administer a PRN controlled substance. 8 days after I informed state, I suddenly received a call from the troopers & now my former employer has called licensing & my current employer..they had no choice but to let me go until this is resolved...what recourse do I have against my former employer?

Apparently none. Based on your post, they simply passed on the facts of an investigation which is relevant to this employers business.

how did your former employer find out about it? If you were not "under investigation" at the time they told your employer then it could be case for slander.

So you are under investigation for narcotics theft? If so, why didn't your current employer hear it from you?
If it's true, you have no recourse whatsoever. Truth is an absolute defense against slander.

I just got the call from the trooper a few days ago & questioned the validity because upon trying to call the trooper back, I was unable to reach him & never got a call back in response to my messages. I'm not guilty of the theft, the accusation is retaliatory for answering state's question about the administration of the medication to a resident.

Unless you can prove the report that led to this was without merit and malicious, you have nothing.

how does that turn into an investigation for the theft of drugs for you?

Upon shift change, my co-worker & I were going to do the required narcotics count & discovered the bottle of liquid morphine has spilled entirely into the safe it was kept in. As required by state regulations, we filed a lost narcotics report with Licensing. All was going as expected until I spoke with Licensing & informed them of the nurse's delegation to me to administer the morphine to the resident, which is against state regulations. Suddenly, a week later my boss called the troopers & filed a report of "stolen narcotics". This then was reported to Licensing, who has to consider it an active investigation.

And in that week, you had already left that employer and moved on to another? Is it possible that prior to you leaving that drugs did disappear and somehow suspicion fell on you? It wouldn't be uncommon if your departure was sudden and/or unannounced.

It is also possible you and a co-worker conspired to steal morphine and you quit when confronted.

As of my last day worked there, no drugs had disappeared, there was only the loss of the morphine due to the above mentioned spill.
