If it isn't court ordered, how did you come up with the $100 figure?
Spoke to an attorney who said the minimum by law is $100/monthly.
until a court orders it, it is not mandatory anything.
has paternity been established yet?
Is the mother seeking child support through the courts?
Have you been paying through the state?
Not seeking thru courts, but may be beneficial to do outside of court order as the minimum since she keeps threatening to revoke my rights which I'm told she cannot do. I'm just trying to do the right thing in giving some $.

No paying by money order with copy of receipt to show I have been giving something. We are not married.
Ok, so right now you do not have an order for visitation either? Again, has paternity been established?
No paternity not established but know it is my child, name on birth certificate as father. Which I know does not prove paternity.

it doesn't prove paternity but it indicates you signed an acknowledgment of paternity (or whatever your state calls a voluntary acceptance of paternity). That does establish paternity unless disputed.Quote:

Unless the amount is court ordered, failure to make any payment will result in the mother getting less money and a reason to file for child support through the courts.
as to rights: you have none at this point. The mother is default custodian of the child so at the moment, she holds the cards regarding you seeing the child. If you want something mandating she release the child to you, you need to go to court.
So legally I don't have to give her anything unless the court mandates it, so much for trying to be a nice guy. Thank you very much for your feedback.
don't take my statement as you shouldn't give her anything. If it is your child, even if you aren't mandated to give anything, morally you do owe for the support of your child.
and, as I said, if you do not pay, she can always file for child support with the state who will impute an income and base the support on that. Depending on your training and education, it may well be above minimum wage which could result in a greater than that $100 minimum requirement.
