Keeping Guardianship When Mother Wants the Children Returned
My question involves guardianship in the State of: Missouri My son passed away in May 2012. His wife was in jail for DWI and got temp guardianship of their 2 children ages 3 and 7. We went for perm guardianship for the youngest last month, we went for the oldest this month. His mom was released from jail and wants visitation and to take the kids back. Here are her issues:
1. long documented history of alchol and drug abuse
2. no home, living in half way house, no auto, no job
3. had her rights terminated on two previous children b/c she burned the child with a cigarette lighter.
I am willing to let her see the kids with me but the Guardian inleitm wants us to allow her to take them after a few visits by herself. We signed paperwork that we would but do not want to do this. How can we prevent her from taking them and getting them back perm due to the eminent danger that she produces.
Re: Keeping Guardianship When Mother Wants the Children Returned
If the court finds it acceptable for the mother to have unsupervised visits, then that's what will happen. If you believe you can document sufficient danger to the children to allow only supervised visitation you can attempt to make that case to the court. Unsupervised visits are the norm, and it sounds like the GAL is going to recommend unsupervised visits, so consider working with a lawyer.
