Change of Venue Letter Contains Incorrect Ticket Number
First of all, thank you for allowing me to the forum, I plan on sticking around awhile, as a future business owner, there are always things to learn in regards to the law.
My question involves traffic court in the State of: New York
I received 5 computerized uniform traffic tickets from the Suffolk County Sheriffs Office (all of which I will fight in court if need be, as I was avoiding a potentially major accident)
The charges includes:
Reckless Driving (Misd)
86 in a 55 Speed over 55 zone
(2) Disobeyed Traffic Control Device
Moved from lane unsafely
The tickets were scheduled to appear at First District Court, which does not do plea bargains.
I have since received a typed letter from the Islandia Village Court (which has plea bargains and is a different venue), indicating that my court date is NOT a court session, and that I should appear approx 2 weeks on a later date. The letter refers to ticket (s), however the ticket number provided in the letter, however close, does not correlate to any of the ticket numbers on the uniform ticket. I am assuming this is a change of venue
Can I request a motion to dismiss, being that they are requesting I appear for a ticket number that does not match the tickets issued?
Re: Change of Venue Letter Contains Incorrect Ticket Number
You won't get a dismissal over a minor clerical error in a court notice. You may want to verify that the letter was intended for your case.
