How Does PERM Labor Certification Work
I would like to get your insights on the implications of discrepancy in education requirement between ad description for job posting and PERM application:

    - Ad for job posting for PERM includes 'bachelors + 5 years of experience'.
    - In PERM application, the 'Other' box is checked in Education section and '3 years or 4 years bachelor degree is acceptable' is stated.

Can you pls clarify whether the above discrepancy would lead to any issue while processing PERM application OR whether ad description is OK for processing PERM?

    Thanks much for your insights.

The U.S. Department of Labor website has tons of information about this: http://www.foreignlaborcert.doleta.gov/perm.cfm

However, from my experience this discrepancy is common and won't affect processing PERMs.

The immigration attorney assisting in the filing should have advised HR of the proper format for all ads. If an attorney is not involved, the employee should be concerned.

Attorney was involved with HR directly. However, I wanted to get additional opinion before I approach HR/attorney about potential implications of the discrepancy.

Thanks much for clarifying. It sounds like it is a non-issue.

The attorney is not engaged by you but by your employer. All questions should go through them. This is a long process, and you will not be doing yourself a favor if you second guess and question the attorney's advice to your employer along the way.
