My question involves criminal law for the state of: Assault and Battery.
So in my class, we are doing mock trials. The mock trial i got was to prosecute a person who has committed assault and battery in Ohio. The defendant walks into a bar with her new boyfriend. When they walk in, the boyfriends recently ex- girlfriend was in their totally drunk. They start exchanging vulgar comments and the victim that was in the bar first starts the fight. She then gets destroyed by the defendant thats when the victim gives up and lies on the ground trying to protect herself. The victim is severely injured but the defendant has a couple minor scratches. What can support our case that the defendant committed assault and battery?
