You call and tell him he's fired, and to cut you a check for any unused money that has been paid out by you. If that deposit is exhausted, you ask him to bill you what is owed and you then put a check in the mail for the remaining balance.

Thanks...i will. So frustrating. I have looked at the case online and there must have been something filed as it says he is retained but the only docket entry i could find was a change of email. Other than that he hasn't got any files. Also we had 20 days to respond to interrogatories etc...it is now over 30 days ago. Are we looking at default? Am i asking too much to be given status updates for someone who is charging me 375 an hour? I am giving him one more shot and, today, sent a very nice and short email asking exactly what we are waiting for....here's where i have a big issue. He is going to charge me to read it and respond to it. Ridiculous.

A party's failure to answer or object to interrogatories may subjects that party to sanctions under Fed. R. Civ. P. 37.
