    I Was Assaulted by My Ex-Boyfriend, but I Was the One Who Got Arrested
    Florida......
    I was involved in an altercation with my ex boyfriend at his residence. I was beaten and had to defend myself. He was the one who attacked me, and this is not the first time the police have been involved in our relationship. He has a record for battery and assault from a previous relationship, he was convicted. I had a few questions.
    What are the odds that I will be convicted seeing that I was the one being attacked?
    Why wasn't he arrested?
    Will my mugshot be removed once I am found not guilty?
    How do I go about pressing charges on him, for this altercation, can I coutercharge?

    Other than your being at his house and your claim that he started it, you've shared no relevant facts. We cannot analyze a situation we know essentially nothing about.

    Didn't you report his alleged acts to the police at the time they responded to the call? If not, why not? If so, you can talk to your lawyer about the possibility of supplementing the police report with the relevant details you left out, but I would be hesitant to make a statement to the police or prosecutor if I had pending criminal charges.

    1. Nobody can guess. But being attacked doesn't mean you can beat up the alleged attacker. Your attorney can guide you further.
    2. Not enough evidence?
    3. Don't assume you will be found not guilty
    4. Make a police report.

    He picked me up from my home to give me a ride to work later on that day. He brought me back to his residence. An argument manifest over a text message. He then took my cell phone and started beating me, kicking, punching and slapping me. I tried to run to the house phones, he continued to move them out of my reach. He wouldn't allow me to leave the house nor would he return my phone. After the beating he threw all my belongs except my phone and my shoes. While I was sitting outside he called the police saying, he needs a woman removed from his home. After he hung up with the dispatcher, he threw my phone outside the house, onto the porch I picked the phone up and called deputies as well. Once they were there I told the deputies exactly what I just stated. I don't know what was said by my ex. I wasn't asked to write a statement. The officer took a picture of my injuries (scratches, bruises). And he went back into the home, when he returned he asked me to turn around and place my hands behind my back... He told me I was being arrested for dating violence.

    Did you ask that he be arrested?

    Did he ask that YOU be arrested?

    Have tyou read the police report?

    When the police arrive at these scenes they can evaluate what they see, but their impressions are also skewed by what they are told. If you played down the violence against you or he characterized you as the instigator and primary aggressor, then you can go down.

    Your lawyer will be in the best position to advise.

    I didn't beat him up. For the most part I was covering my face.... The only physical contact I had was a punch to the arm.
    He has assaulted me before and the police were involved. There is a paper trail, and there waa physical evidence of my shirt being ripped as well as bruises on my arms and scratches around my neck.
