Think Estates of Ron Goldmen/Nicole Brown suing OJ Simpson. The criminal case was lost. The Wrongful Death case was won....
But ... how does a phone call show ANY objective involvement in the crime? It implies some sort of knowledge - or terrifying coincidence - but no actual involvement. With what has been presented there would be no grounds to even bring a lawsuit. While a lawsuit might need less evidence, it still needs some.
