    Can I Move from a Threating Situation
    My question involves a child custody case from the State of: texas

    My ex and I have a 7 month old. He was violent before and during my pregnancy. Once I had my child I ended up kicking him out. Since then he has been threatening to kill me, he stalks me and I have had to call the police 3 times for keying my vehicle. I am afraid of him but I do not have enough to get a protective order. I am wanting to leave the state to get away from him. We have never been married or commonlaw. We have no orders of custody or orders of any kind, however he did sign the paternity paper at the hospital. Am I able to move away without getting in trouble legally?

    Yes, you can leave - but expect him to file immediately in Texas to have the child returned pending a custody hearing.

    Can you afford to keep coming and going back and forth to Texas? What will you do if the court orders that the child must remain in Texas?

    Did you petition for a restraining order and were denied, or are you making an assumption that you don't have enough? Threats to kill, stalking, those are sufficient reasons for many judges to issue an order.

    You might also want to consider a safety plan in case he confronts you or you find yourself in danger. If you haven't already contacted the National Domestic Violence Hotline and asked for a referral to the nearest DV outreach center where you can get help developing a safety plan, please consider doing so now. Their number is 800-799-SAFE. DV outreach centers often employ advocates and this means you can often obtain help without having to stay in a shelter. Advocates can assist with things like filing for a restraining order as well as provide first hand knowledge of the local judges, legal climate, etc.

    TX is actually very lenient when it comes to granting RO's. To whom did you inquire about getting one?
