    Ticketed for Not Having a Parking Permit, Which I Actually Did Have
    My question involves a traffic citation from the state of: FL

    I was given a citation by my University PD for supposedly not having a valid permit on display. I have had my new, valid permit on my car since Aug 20th. It's in the same exact place as my permit from last year. I literally placed it directly on top.

    I called parking and transportation immediately to have them come and look at my vehicle, and they told me that it was too soon and to call back tomorrow. I immediately took a picture of my decal before leaving campus.

    I filed an online appeal when I got home, and submitted the photograph as proof. My appeal was denied. I am now awaiting my second appeal date.

    Can someone please help me as to what to do next?

    I must be missing something. If you have a valid decal on and even presented a picture of it and they denied your appeal, there must be something else going on. Either the permit you have does not allow you to park in the 09 education blue lot or, if there are registry numbers on the sticker, it doesn't show that it is registered to your vehicle or...?

    should have posted before you filed an appeal ... now where are you at? 2nd appeal?? With who? Is this a de novo hearing?

    My appeal was denied because the officers statement says that I had a different decal on my car at the time. He swears I must have changed it.

    Judgment Decision: The statement taken at the time of citation notes an expired permit (which has the barcode above the
    logo) as the only permit on the vehicle.

    I have multiple permits on my car, one for Palm Beach State College (which allows parking at the FAU campus), and an FAU permit which allows parking in Blue lots. All blue lots are the same. We have blue for commuters, red for faculty, purple for grad students, and green for students who live on campus. Lot 09 is a blue lot and I am allowed to park there. I have been for almost 3 years now.

    This is a copy of my parking permit. As you can see, it's clearly valid. I got out of class at 11:50, which is documented. The picture was taken at 11:57 (timestamp is shown under details in my phone). Anyone who's ever been to a major university knows you can't get off campus in that amount of time, and I live about 15 miles away. It's impossible that I could have gone home and put it on in that time as the officer accuses. I would think that since I called them immediately to have them come back out and verify (before even leaving the lot), and they told me they couldn't, that I would have a pretty good argument against what he claims?

    A photo only proves that you had the permit at the time you took the photo. It doesn't prove that it was on the car at the time you were ticketed. For all they know, you ran out, got the decal after you found the ticket, slapped it on, and then took a picture.

    I'm not saying you did that. I accept your word that you got the decal on a timely basis and that it was on the car when you got the ticket. I am explaining why the photo is not acceptable proof.

    Generally, the hit squads from parking services are deemed to be more reliable than lowly students.

    Then what would be acceptable proof? Is it just his word against mine? I've had my decal since August 20th, which is documented in their systems and in my email. I've spent more than 80hrs on campus since then.

    I'm just looking for what kind of defense I could use? Most of us know if it's an officer vs a civilian the officers word almost always wins. I'm a 4.0 student. President's honor list, Dean's list, I've never so much as even been pulled over before, let alone gotten a ticket or been in trouble.

    Do I have the right to have the citation heard in court, since it's campus police?

    Update: My second hearing is scheduled for September 25th.

    If anyone could help me with ideas, that would be awesome. Even if it's just speaking from personal experience. I've never had a ticket before, and nobody I know has ever gone to a hearing over a campus PD ticket. I'm assuming it's different since it's a board from the university instead of an actual court hearing.

    so, how did he see the old barcode if you did this (as you said in your first post)

    If you placed the new one directly on top, the cop wouldn't have been able to see the old barcode, right?

    You can see through the sticker a little bit, but not enough to be noticeable unless you're purposely looking. He claims that I had an older, expired sticker on at the time of the citation.

    That was't me saying that about the barcode, that was the school's reply to my appeal.

    His statement says I had a different sticker on, which is what they based their decision on. His statement is the only thing that they have as evidence.
