    My question involves civil rights in the State of: California.

    Can I sue a hospital for apparently filing in a medical report apparently fraudulent information about me as having, without providing any evidence of me ever having, a history of alcoholism and cigarette smoking?

    This report was prepared by whom for what purpose, and given to whom, by whom, for what purpose? Why would the hospital have concluded that you are an alcoholic and smoker?

    A social worker prepared that medical report while interviewing me in a psychiatric-hospital inpatient pre-hospitalization mental-health status review. In that same interview, that same social worker failed to consider the fact that my having gotten drunk a few times in the past and my having held one lit cigarette in my hand and up to my mouth are not really indicative of any addictions on my part to any alcoholic beverages or cigarettes.

    I am degreed with only undergraduate degrees but with no advanced degrees and also in the wrong subject areas, unemployed, self-employed with hardly any jobs or assignments, bankrupt, lacking in any partnerships from any businesses as well as from any relationships, intolerant to wearing any eyeglasses or contacts and, therefore, to any driving or passenger-riding, permanently physically disabled with elevated bilirubin levels, HSV-1, and a gall bladder polyp, historically marked with certain class rank lies on my high school transcript, and permanently residing in a month-to-month agreement in a hotel room in a hotel that does not allow any visitors.

    I'm still waiting to hear what damages you have suffered that are directly attributable to the social worker's report.

    Irrelevant. There's no way any of this is attributable to the social worker's report.

    OP is attempting to go for SSI it appears and is afraid the alcohol will kill his chances I believe.

    Why would any of the lies reported in my medical file not have caused any of those damages that I have herein described? What kinds of damages could be caused by the kinds of lies reported in my medical file?

    Sorry, refusing to wear glasses and making poor choices in your sex life are not going to get you SSI. Apparently, the social worker made an interpretation of what they believe is fact. I'm sure the cigarette in your hand was simply a result of your holding it for a friend.

    Specifically, how has this social worker's evaluation harmed you? How has this evaluation in a document available to almost no one forced you to be unemployed, without personal relationships, and without advanced degrees? Seriously, how?

    I have lived for over a half century and have never had to provide a medical file to prospective friends or romantic interests. Nor have I ever had to provide them prospective employers. And I have yet to have a college (undergrad or grad school) request ANY medical information at all. And how in the world would it have anything to do with your medical condition and even alleged lies on your high school transcript (that likely occurred many years before the SW review)?

    None of those conditions you describe have ANY impact on some written opinions of a social worker.

    I suspect that your stay in a psychiatric hospital may be far more indicative of the reasons for your disassociation than any report by a single social worker. A mental health problem is likely to be more stigmatizing than the words of a social worker that you might have an issue with alcohol and cigarettes.

    Your problems are clearly from something far more serious. I encourage you to seek and maintain appropriate professional assistance.
