Charged With Larceny and Driving Without a License
My question involves criminal law for the state of: Michigan
First of all let me start off by giving some information about myself. i am 17 i have an extreamly clean record, no violations what so ever, but that all changed one night about two weeks ago.
my coworkers wife was out of town (he is 22 btw) he wanted to go out so we went to a strip club, we walked in there, there were no questions asked what so ever. after a few drinks, the shot girl (emily) was checking me out, i made a move and a couple hours later we were headed to a hotel to spend the night together, she had asked me to drive, i do not have a license btw. we got to the hotel had a good night. a few hours later she fell asleap at 6 am. i couldnt sleap at around 730 i decided to go grab some breakfest for her and myself. that is were it went horibly wrong. i obviously took her car my phone was off, but by the time i got back to the hotel as soon as i parked the cop arrested me, i had two cups of coffee from tim hortins and two bagels with me so obviously i thought the cop would figure out this is all a miss understanding. i come to figure out she had reported that i had stolen the money she had had in her purse, she had reported 100$ i had 285$ with me that the cop counted. the cops tried to get me to confess by telling me "'tell me how much you took from her and will give it back to her and will all be on our marry way, will let you go'' i told em this is all a misunderstanding i cannot confess to somthing i didnt do, if its money shes after you can give it to her if this nonsense stops. the searched me again and found her earings in my pocket she had given them to me last night when she was cashing out because she had to go to the back for a lilttle and my coworker was leaving, she handed me them told me she wasnt leaving and have a seat at the bar. and i had compleatly forgoten about them. when the cop pulled them out of my pocket i panicked and i did lie and i said they were my girl friends. what ended up hapening the cop took 100$ of my money and handed it to the shot girl (emily) who btw used a fake id to get the room we were staying at since i was underage. i found that to be compleatly unjust since i am suposedly innocent until proven guilty. especially for the fact that after that i was taken to be fingerprented and processed i was charged with larceny and driving without a license. first thing first, i did not take a penny from that women. my parents dont help me with school, i go to university of michigan, i cannot afford a lawyer what so ever. so hear is my question what can i possibly due to get the fines down to a minimum? seconed how to get rid of the larceny case? and third i turn 18 seven days after my court date, could this affect me getting my license? and if so what can i do to avoid this?
any and all help is greatly apreciated! and thank you for taking the time!
Re: Charged with a Case of Larceny and Driving Without a License
1. They really let a minor into the club...underage?
2. You went home with a girl you just met? Dude, ever heard of STD's?
3. Since you are in college and your parents don't help you with school....I assume you have a financial aid or scholarship....you want to minimize the damage as much as possible. Get a Criminal Defense Lawyer. If you can afford a strip club, hooker, hotel, breakfast...you can afford one...If not, plead not guilty, ask for a public defender.
Just know that any criminal charges can mean bye-bye to your scholarship or financial aid...

What, exactly, are you charged with (by statute number)? From your story, you may be charged with more than just a petty theft charge. Even though you brought it back, you took the woman's car without permission. That could lead to an auto theft or, at least, MI's version of joy riding charge...likely a felony. Then, there is the money and earrings...that could be yet another charge. The DWLS is the least serious of these offenses! Considering the circumstances, I doubt that you are going to "get rid" of any of these charges without the help of a good attorney. You shouldn't be worried about how to "get the fines down." You should be more concerned with staying out of jail.
Re: Charged with a Case of Larceny and Driving Without a License
charges by statue number: 12C3127OM & D01 Larceny i belive those are the charges, i found them on my bond. are those them? like i stated i turn 18 seven days after my pretrial, will i be charged as an adult or a minor? both charges are misdemeaners, i wasnt charged with grand theft auto or joyriding to my best knowlege. to the driving without a license charge i obviously have to plead quilty, right? will it affect me getting my license when i turn 18? as of the larceny charge i didnt steal a dime from this girl, what can i do?? and the fact the officer took 100$ from me and handed it to the girl isnt that eligal? also my coworker can atestafy to how much money i had at the begining of the night and how much we spent even the hotel, to prove i didnt steal anything. and last but definetly not least, i work full time to cover the expenses of school, but without the financial aid i get there is no way i could aford it, can i loose my financial aid?
again all and any help is greatly apreciated, thanks for taking the time.
Re: Charged with a Case of Larceny and Driving Without a License
can you get your story straight?
the searched me again and found her earings in my pocket she had given them to me last night when she was cashing out because she had to go to the back for a lilttle and my coworker was leaving,
Your co-worker has no idea of what money you had on you or you spent AFTER he left.
And no, you will not be getting your license when you turn 18, with the Driving Without a License charge.
Re: Charged with a Case of Larceny and Driving Without a License
No, those numbers do not appear to be statute numbers. You are most likely charged with:
750.356 Larceny; property; penalties; total value of property stolen; enhanced sentence; prior convictions; "nonferrous metal" defined.
(1) A person who commits larceny by stealing any of the following property of another person is guilty of a crime as provided in this section:
(a) Money, goods, or chattels.
. . .
(5) If the property stolen has a value of less than $200.00, the person is guilty of a misdemeanor punishable by imprisonment for not more than 93 days or a fine of not more than $500.00 or 3 times the value of the property stolen, whichever is greater, or both imprisonment and a fine.
It is possible that you will be charged as an adult, but maybe not. And, yes, a conviction for this (or any other criminal offense) could negatively affect your financial aid. The driving without a license charge may negatively affect your ability to get a license - there may be a suspension period after conviction. Like I said, you need a lawyer.
Re: Charged with a Case of Larceny and Driving Without a License
It's inevitable that he'll be charged as an adult - at 17 in Michigan, you are always charged as an adult.
The fact that you chose to lie to the police will make life very difficult for your lawyer if you try to go to trial.
Talk to a criminal defense lawyer about the possibility of a deferral or HYTA.
