Can a Traffic Violation Resulting in Arrest Violate Your Probation
My question involves criminal law for the state of: Florida
My fiance is on probation for a year. He was recently arrested for something stupid, they charged him for a NON moving traffic violation but they let him out on bond and he was out in three days. He has a court date coming up and my biggest concern is did they count that as violating his probation because i know usually when violating you get sent to jail with no bond. And what are the chances they will lock him up again on his court date?

Chances are low, if they let him out. Tell him to stop doing stupid things while on probation.

That would be entirely up to the probation officer....have to ask or wait and see...

States vary, but my experience has been to not violate for a local ordinance violation. That is, if the offense is a fine only offense, I don't violate.

A fine only offense. Speeding, running a light, failure to use a seatbelt, etc...

Note that if you engage in acts that cause the police to arrest you, even if you aren't charged with the underlying conduct or it's a low-level offense that the probation officer might otherwise excuse, your conduct leading to arrest can also be considered and it's possible that the mere fact that you were in such an encounter with law enforcement violates your probation.
