How to Move Out if You're Not Eligible for Emancipation
My question involves juvenile law in the State of: Kentucky
since a 15yr old cannot be emancipated in the state of Ky what other options do they have? The child only has one legal guardian their father however he is not fit he is abusive both physically and mentally at times but the child always ends up back with him. Father has been in jail several times for drugs and physical abuse of others, while the child bounces around with other family members. How can the child choose who they want to live with without having their fathers permission?

He can't. It really is that simple.

Yep. He's a minor. It's not his choice to make. Either he lives where his father says he lives, or he lives where child protective services and the courts say he lives. If he's being abused, he needs to be calling police or reporting the abuse to school officials ASAP when it happens. It will ultimately be up to them to present his situation to a judge, who will be the determining opinion on parental fitness - and from there determine possible alternatives. Bottom line is that children don't get to choose.
