Does a Divorce Decree for a Marriage During Another Marriage Get Voided
My question involves a marriage in the state of: NJ
This might be a little complicated...
If someone gets married. Then gets married again before the divorce of the 1st wife is official. Then divorces the 2nd wife... Does that cancel what ever was in the 2nd wife's divorce decree?
Re: Divorce- Does a Divorce Decree for a Marriage During Another Marriage Get Voided
Your question is a bit convoluted, but not complicated as such. One presumes the first divorce came through, and that you're saying this person remarried knowing for a fact that his divorce hadn't come through.
Your question also seems to indicate that the 2nd wife only found out about the divorce date long after HER divorce (vs. before or during).
If someone's thinking they can go back and re-do a settlement agreement because under the above scenario, I don't see it, but you haven't presented much info. The law may well say the 2nd marriage was no longer void or voidable because the breach (in effect) was cured by the 1st divorce coming through. This is something you'd ask a NJ family law attorney about.
