    Can You Stay in the U.S. if Your Child is Born There
    Hi I am going to leave the US Friday, but it breaks my heart because I am going to leave my girl friend who is till under going divorce with our unborn child. Will I be anle to stay with them in the future. If so how??

    Please help. My girl friend will suffer a great deal ofhardship if I dont go back

    As it stands, as is beyond obvious, you cannot enter as the fiance or spouse of the mother - she's married to somebody else. Unless and until the divorce judgment says differently, her husband will be presumed to be the child's father. When she's divorced, assuming she's a U.S. citizen, you can start figuring out how you might immigrate based upon your relationship with her.

    You are a tourist, so you can't legally work. The "great deal of hardship" would be what? Missing you?
