Corporation Won't Rewrite My Checks
My ex boss won't rewrite my checks they checks are overa years old I been trying for months to get them rewriting, and he refuse to. I tried to cash the check and they came back insuffient fund, but I call chase bank and verified the checks and amounts and they funds are in the account. My question is can he hide behind he's corporation and what can I do to mak him pay me. These are commission work checks, for his corp and he is then resident of the corp.

if this is for wages, contact the dept of labor or whatever it is called in your state. Since you ignored the prompt to provide that info, I can't tell you what it is called.

Sorry I'm new to this. These checks are commission check of wages. I work on a 100% commission job. So they are paychecks. I hope I answer your question correctly. And yes there a contract we all signed. I do have legal bank copies of the check, he won't rewrite them, because he said he will hind behind his corporation, please help.

so, give the DOL in your still unnamed state a call an ask how to file a complaint.

Thanks for your response, it was a wages, I live in California . He told me he will hide behind his corporation. They will have to go after the corp not him and he will never pay. Can't the police or labor board make him pay. The amounts of checks are $49,000.00.

California, is the dol, department of labor correct. I'm sorry I have no clue about these stuff, I think that is why he think he can screw me.

they take whatever action needed to compel the employer to pay the wages. just make the call.

I will, do I have to wait until the expiration of a demand letter I sent to him by certified mail. The date respond date is at the end of next week. Could I proceed before.

Unless you made some promise to not take any other action prior to the expiration of the time allotted, file the claim.

I gave him a dated to pay by, if not I will take legal action.

Will the bank accept the checks if you redeposit them? (The mere fact that it's more than six months old won't prevent the bank from honoring an otherwise valid check, consistent with its policies.) If so, and you verify a sufficient balance to cover them, go for it.
You can inquire with the police about their 'bad check' procedures, although if you try that it sounds like your delay in reporting may become an issue.

As you've explained elsewhere, these are not wages. They're payments to you for work performed as an independent contractor. You have stated that payment was to your "DBA", making it appear that you knew what you were doing and intended the contract to be business-to-business - but that can be discussed in your other thread.
