Will My Brother Have Problem
My question involves criminal law for the state of: New York
My brother was caught shoplifting in Apple store in New york City.
The value of merchandise being more than $100, he was arrested and taken to the precinct and booked. The court notice mentioned the charge as Larceny but also mentioned ACD - adjournment in contemplation of dismissal. And his case dismissed today.
He was told by the lawyer there that ACD will disappear when the case be sealed, as something that never happened.
The thing is: We are from Brazil, he has a legal tourist VISA and everything. He goes to NYC every year to spend his college vacation. His case is going to dismiss today. So, the question is: Will him have problem to go back to NY again after his case is dismissed? Will him have a problem with the immigration?
I'm asking that because he was fingerprinted there, and I am worried about him. I don't want to see my brother being deported on his vacation. By the way, he is going to NY next december.
