Contesting Stop Sign Violation
My question involves traffic court in the State of: NC
On my way to work today I was pulled over by the State Highway Trooper on a rural road for failure to come to a complete stop at an intersection. The road is a two lane road with a small grass median between the two lanes (similar to a "Y" at the location of the stop). On the right hand side is an old country store whose parking lot meets the road.
After doing some research, it appears that the federal laws for stop sign placement are violated for this intersection. The stop sign is located on the left of the road because the right side of the road meets with the stores parking lot as described above. This appears to be a violation of 2009 MUTCD section 02B.10 for stop sign placement (the stop sign must be installed on the right hand side of the approach to which it applies.) The intersection is particularly odd because the area of the road that turns right is almost a "Y." This further obstructs the visibility of the sign that is only placed on the left side of the road.
Can I contest this ticket as the stop sign placement is not in accordance with the Federal guidelines? Is there a guideline that can override the placement of the stop sign and only allow for a sign on the left of the road? Should I hire a lawyer to contest this?
