    Filing a Civil Suit for False Arrest
    My question involves criminal law for the state of: Ohio
    I was arrested after being accused of theft on two separate occasions from a store. I was not shown a warrant or read my rights, but was shown a picture of myself in the store, and I admitted it was me. (I did NOT commit the crimes.) I spent a few hours in jail. My charges were dismissed without prejudice months later. The video evidence shows me in the store; one date just shows me walking around, the other shows someone (possibly me) with their back to the store camera, spending some time in one area. This was not the aisle where the items were supposedly taken from; I have never even looked at that type of item in the store and I wasn't in that aisle that day.

    I would like to recover the $3000 I paid to my criminal attorney. Is a civil suit possible? And who would be liable - the store, or the prosecutor/police for not investigating fully? This has been extremely stressful and embarassing.

    You have not shared information suggesting that you have a viable legal claim against anybody. You retained a lawyer - discuss this with your lawyer.
