How to Begin an Action for Visitation or Custody
My question involves a child custody case from the State of: Kentucky
Both parents lived in Colorado (not married) child was conceived. Mother moved to Kentucky, Father to Nevada.
Child was born in Kentucky. Child is 3 months. Immediately father flew to KY to have DNA testing. He is the father.
Father has flown mom & child to NV on two occasions for visits. Father has been sending money to mom weekly.
Most recent visit to NV, father wanted to get the birth certificate amended with his name included. Wants to establish his paternity and begin paying child support through the state. Mom flipped out, assaulted the father, mom was arrested and charged with domestic violence. Mom was also recently evicted from her apartment for noise complaints or something to that effect. Mother has since been released from jail and was granted the child back since father has not established paternity with the state yet. They (mom & child) are now back in KY. Father would consider full custody but definitely wants some type of visitation. Can anyone point us in the right direction as to what should be the first order of business. Father has contacted several lawyers, there seems to be a question of jurisdiction. Any and all advice is greatly appreciated.
Re: No Idea Where to Begin with Custody/Visitation Issue
Kentucky has jurisdiction.
Dad needs to file to establish paternity. If he's the father, he can then petition the court for joint legal custody and visitation and set up child support himself.
Re: No Idea Where to Begin with Custody/Visitation Issue
Dogmatique- Should the father seek an attorney to file to establish paternity in NV or KY since the mother and baby like in KY? ANY help is GREATLY appreciated!
Re: No Idea Where to Begin with Custody/Visitation Issue
Did you miss the part about KY having jurisdiction? :)
(Why the different screen-name, by the way?)
Re: No Idea Where to Begin with Custody/Visitation Issue
Different screen name because it's a different person.
Re: No Idea Where to Begin with Custody/Visitation Issue
Thanks, Sherlock - that hadn't occurred to me.
Perhaps the involved party can gently inform the non-involved party that s/he can take of things his/herself?
;)

No need for the nastiness Watson !
Re: No Idea Where to Begin with Custody/Visitation Issue
That wasn't nasty.
But when we have two different posters asking about the same matter, it gets convoluted.
However, since you've BOTH been told the same thing...
Re: No Idea Where to Begin with Custody/Visitation Issue
Well if you had slowed down long enough to read nhc's question, it also asked "should the father seek an attorney" or did you miss that part?

From post #2.
