Thirteen Year Old Child Wants to Be Emancipated

I am trying to get emancipated in Utah:
I am thirteen years old and both of my parents work 5 days a week. I have to take care of my brothers and sisters. I take care of three kids my sister page is nine, my brother Waylon is eleven, and my lil brother willy is 3. My parents put too much responsibility put on me. I have to have the whole house clean before my parents get home from work. I don't get any allowance and my parents never buy me cloths or shoes my cousin gives me hand me downs. I am very stressed all the time. None of the kids help out an my parents don't let me go any where. I can't hang out with friends and I can't do anything ever. I'm sick living like this. My parents don't appreciate me at all. They both are very selfish and controlling. If I don't clean the house in time or if I try to stick up for my self I get whipped with the belt. My older sister mckenzie is 23 and lives in Montana. She has one kid and I tell her everything and she gives me advice. She told me to try and get myself emancipated and shell come and get me to live with her but I don't know how to emancipate myself. Any ideas? My parents also won't sign for emancipation because they won't have anyone to take care of the kids or clean the house. My lil brother willy that's three calls me mom and I try to tell him that I'm his sister but he doesn't understand. I need an answer please.

Harlierose, your sister is obviously as naive about reality as you are, in spite of her being 23. First, you are not even smart enough to start your own thread.

The law does not require you get an allowance. Get more sleep.

Sucks to be you. That said, you have no legal basis to claim anything. You don't have the right to go hang out, that is a privilege. Utah code 76-5-09 sets the outside parameter parents must stay within, when disciplining their children. You don't come close to that. http://le.utah.gov/~code/TITLE76/htm/76_05_010900.htm You do not get to go shack up with your boyfriend, just because your hormones are calling you either. How can you be shacked up at your boyfriends, afraid to go home, when you are already there, forbidden to leave, being a slave to your siblings? Oh, you are lying, I get it.

Neither you nor your sister in Montana has the slightest idea what is meant by the emancipation of a minor. It does not remotely mean what either of you think it means.

First of all, nowhere in the US can a 13 year old be emancipated.

Second, no judge is going to emancipate a child of any age because they have to clean the house or because they have to wear hand me downs.

Third, since you are not already living on your own and managing your own financial affairs, you would not qualify for emancipation EVEN IF you were old enough and EVEN IF you had a valid reason, which you are not and do not.

You seem pretty intelligent and write well for your age.

Have you tried to talk to a teacher you trust or a school counselor about what you are feeling? They may be able be able to give you some helpful guidance.
