My question involves landlord-tenant law in the State of: Colorado
Rent has been paid higher than on agreement for many months. Is there recourse?
How did this comes to happen?
The one paying the rent just had in mind a higher number than was actually on the agreement and has been paying that amount. Forgetfulness..
you figure out how much too much rent was paid and subtract it from next months rent payment. The landlord doesn't just get to keep the over payment. It would have accrued as a surplus towards your total rent just as if you make extra payments on a loan or mortgage.
If the amount is more than a single month, then you go however many months are already paid and then start paying after the surplus runs out.
