Length of Ban for Single Illegal Entry Over 30 Years Ago
I am a USC trying to bring my father into US, my mother has been approved. My father was involved in a ONE TIME illegal entry into the US over 30 years ago. It was just a simple illegal entry no other circumstances involved.
I am now in the process of filing an i601. But I would like to know what is the maximum ban time for such an offense and has it been long enough (30+ years) that it has surpassed the ban period?
here is the law section:
INA 212(a)(6)(C)(i)
I cant tell from reading that if there is a ban period.
Thanks for any advice!

You are stating that he has been explicitly banned under INA Sec. 212(a)(6)(C)(i)? A ban under that provision, "Any alien who, by fraud or willfully misrepresenting a material fact, seeks to procure (or has sought to procure or has procured) a visa, other documentation, or admission into the United States or other benefit provided under this Act is inadmissible", is permanent. He can't enter without successfully obtaining a waiver of his inadmissibility. See INA Sec. 212(i).
This is one of the reasons we repeatedly tell people, "Don't lie to the USCIS".

Thanks for the quick reply Mr Knowitall :)
Yes well the poor and desparate don't even know what uscis is, especially if they are from a poor country. Unfortunately for me. We'll see how the waiver process goes.

Maybe they should stay in their own country, instead of illegally crossing borders and committing crimes in other countries. I suggest you check the definition of the word parasite.
