Who Gets Custody When One Parent is Out-of-State and Does Nothing
My question involves a child custody case from the State of: alabama if my childs father stays in another state and doesnt do anything for her now can i take him to court for custody because if somethings happens to me i would want her to stay with my parents cause he said he would come and take her but he didnt signed the birth certificate

Yes he is her father but he want help me at all

If you want his financial help (which is the only type of help he can be compelled to give), you'll need to file a paternity action against him, have him adjudicated as the father, and seek a child support order.

Would I be getting him in trouble by taking him to court if he still on paper and he is in another state

There's really no way for us to predict that. But that IS the only way to get child support out of him.
