    Can I remove my wife's green card?
    I am foreign national to work in the United States and I receive my green card in 11/30/2004.
    My wife also receives the green card in 2/21/2005 due to I become Permanent Resident.
    Finally I find out she was want become Permanent Resident, so she marry me. We are discussing divorce right now and she wants our all assets. The question is can I file the good faith waiver in order remove her Permanent Residency status?

    A good faith waiver doesn't do that. It's a mechanism for preserving conditional permanent residency.

    The good faith waiver requires:
    • that the qualifying marriage was entered into in good faith by the alien spouse,
    • that the alien spouse was not at fault in failing to meet the requirement of filing the joint petition, and
    • that the qualifying marriage was terminated other than by the death of the petitioning spouse.
    Grounds may include extreme hardship if deportation occurs, termination of a good faith marriage, or domestic violence against the spouse or a child.
