How to Get Rid of Someone in My Home
My question involves an eviction in the state of: Mississippi
Lil background, I owned a camp in Louisiana that my Uncle has been living in for 3 years since my Father died. My Uncle owned a house in Mississippi and rented it out. In June my cousin called and asked if I would swap properties. I went ahead with the exchange of Deed because the house could be worth more than the camp. (esp, since my Uncle has pretty much destroyed the camp).
June 20th of 2012, I went to the house in Mississippi to meet the tenants in the house. They were really upset and were thinking they had to move. I told them to not worry, We would get together a lease and they could continue renting for the 300 a month. I would come back on July 1st and get them to sign the lease.
On July 1st, 2012, at 8am, the tenants called to ask me if they could only pay the amount that I pay in insurance and the property taxes for the property. I told them that it was almost 300 a month. They stated they could not afford to pay the 300 a month and could not stay there anymore. They wanted 60 days to move out. I told them that if they stayed 60, they owed me 600 for rent. They said they would be out by the end of July. I said they still owe me for living in the house for the month of July. He stated he would send me a ck by the 5th. Well, the 5th has come and gone and No ck. I spoke with the tenants last telling them I was on my way up there to see the house. They got very ugly and irate on the phone.
I went to the Justice court in Pike county this morning and they were no help. I was sent to the county court and they were of no help but to get an attorney.
Any ideas?

I *THINK* it is the township hall to check for instructions on how to file an eviction.

Thanks but, I was told that I would have to wait to see if they move out on July 31st. If not, then I can send a 30 notice to vacate. Then they have 30 days. But, I don't have a lease with them, All I have is a verbal agreement. I can see this is going to be a hard process.

Written or oral, a month-to-month lease is a month-to-month lease. Same deal.
