Changing Your Mind After Requesting a TBD
My question involves traffic court in the State of California, Country of Los Angeles, Compton Court House.
History: No tickets on my record at all. I was not even really speeding, I think it was a quota ticket from CHP. I first wanted to fight it try a TBD and then TDN if that fails, but I'm going to be traveling and I just don't care any more, they screwed me, I just want to pay and get it over with. I don't have any tickets because I honestly don't speed, which makes me the butt of jokes from friends sometimes haha.
1. Got 75 in a 65 on 01/31/12 (impossible maybe 65 if anything, but I think I admitted I was in a hurry so now I'm worried that means I'll lose anyway if the judge hears that)
2. Mailed bail and request for TDB as soon as I got the stuff in the mail.
3. Never got anything, then got a second notice but they cashed my check proving that I got it in, in the right time.
4. Went down to courthouse to straighten this out and got the TR-200 form and a new due date of 07/16/2012.
5. I've since just decided I want to just let them keep the bail and do traffic school.
So either way I'm going to have to go down the Compton courthouse this Monday (07/16).
Since I haven't even filed this TR-200 will they let me just change it to guilty and pay the traffic school fees?
Please help, will I be forced to submit the TR-200 and go through with Trial De Novo in hopes of getting traffic school? Remember I just want traffic school now, I'm not trying to fight anything.

No one would believe that you have never exceeded the speed limit. It is virtually impossible to avoid and that is one reason why most officers won't cite you unless you're 10mph or over...
So you're free to go travelling thinking about quotas, believing they exists and how you got screwed. I would be willing to bet that at the moment the officer picked you up at 75 in 65, you were likely the fastest vehicle he can see; it never fails. At the end of the day, you're only fooling yourself. And maybe a couple of your friends!

Actually, you would have lost even without the judge hearing that. This sounds like a 22349 citation and not even an attorney can manage to win one of those (if anything they might negotiate a different violation but not a dismissal).

Actually, you would have lost even without the judge hearing that. This sounds like a 22349 citation and not even an attorney can manage to win one of those (if anything they might negotiate a different violation but not a dismissal).

You can go to the court and ask, I highly doubt they'll decline your request, but you never know. Only the court can give you a sure answer.
Thanks for the reply and hey fair enough, I didn't really mean to imply that I have NEVER ever exceeded the speed limit, but real truth is, by default the way I drive is under the speed limit. In this case I was in a hurry and driving AT the speed limit (that would be considered speeding to me). There was just no way I was going 75. I was in the crowded HOV lane and as soon as I saw the cop in the lane next to me I looked and I was only going 64-65 and this was enough to pass the cop. The ticket says radar but is it really possible to clock from behind and to the left? He just mentioned that I passed him.
I try to avoid the police at all costs I'm paranoid like that. I've been driving for about 16 years now with no tickets at all, do you think if I routinely sped I'd be able to pull that off? That's what makes this citation even more annoying is that this was absolutely one time when I wasn't speeding (believe me or not). This is why I feel screwed. If I'm going to get a ticket I'd rather it have been on the few times that I actually have had to speed. Is that no reasonable? I have no reason to lie here.
Regarding the quotas I don't know enough to say either way, so I do take that back.
Yes it is a vc 22349.
I will head down there on Monday and try to get traffic school. If not I guess just hope that the cop doesn't reply or show up, and then hope the judge will allow traffic school?

Now the question is, if you were in a crowded HOV lane, you would not be the only one to have passed him -assuming he's doing 65 and only monitoring traffic that is faster than he is-. So why would he choose you to pull over?
Better yet, if you're so sure you don't speed, why would you need to look at your speedometer when you saw the officer?
Fact is, you don't have to answer any of my questions, but you can be sure that nothing you said will make the slightest little difference. As soon as the officer testifies you were at 75 in 65, you've lost the case. And there's not much you can say to try and recover.

I have a few descriptions I can use here but I'll leave those to your imagination. Just think about this the next time you're standing in an endless line waiting to handle a traffic matter in court, how many of the people standing in line ahead of you are there for a legit reason, and how many are simply trying to play the system?
Now don't you all start whining when the fines go up dramatically each and every years... Everything has a price!

The reason I looked was to be sure that I wasn't speeding and I wasn't. I don't believe I'm guilty of anything. The system IS the game, where I'm jumping through hoops just to pay them off. Yes I'm sorry I didn't read here first before deciding on this almost guaranteed to fail path of TBD. If I did I would have just gave up. I get it the game is giving out bogus tickets and then having people realize they should just pay to not waste their time.

I don't have a lot of experience with the long lines because I have never gotten a ticket before and when I went regarding this incident there was no line at all which was great. Again you don't believe me on this haha.
I have to respect that you are the only one who has replied to my topic so thank you for that, but I really wonder where all the hostility comes from? You felt the need to post twice in a row to insult me? I see why you were banned from the other forums. Are you a former/laid off county employee?

You can claim its a bogus ticket... Fact is... Reality is, there is a 95% chance you'll get convicted of this speeding charge whether you like it or not! If you sensed any hostility in my reply, that is your own issue not mine... I simply posted as realistic a reply to your question(s) as you can get from anyone. And I'm not sure which part you took as offensive or insulting; again your issue not mine!
You want to argue facts then bring it on... Which part of what I posted do you disagree with? You want to sit there trying to antagonize me into an argument, you lose!
