    Will I Have to Pay Support if My 18-Year-Old Son Goes to Live with Father
    My question involves child support in the State of: Kentucky My son is 17 and will be 18 in January (before he finishes high school). My son is "threatening" to go to live with his father full time when he turns 18, which he legally can do because he will be of age to make his own decision. Per Kentucky child support laws "provisions for the support of a child shall be terminated by emancipation of the child unless the child is a high school student when he reaches the age of eighteen (18)". His father is currently paying child support to me. My question is, if my son DOES decide to live with his father full-time when he turns 18, will I have to pay child support to his father? (I am currently unemployed)


    Just to give a little "prior" info, I had to take his father back to court when my son was 16 because my son went to his father's house and refused to come back home. I contacted authorities (who would not get involved) and tried to contact the father to talk to him about this and he would not answer my calls and wound up blocking my number so I had no contact what-so-ever. It took several months to get a scheduled court date, but the judgment was in my favor (but there was nothing done for all the lost time with my son). My son does not want to be at my house because I have rules and a curfew that must be followed, where at his father's house he can come and go as he pleases (he has openly admitted this to me). Don't get me wrong, I do let my son do things (a lot of things) with his friends, but I give him a curfew, which he does not like.

    Maybe. It depends on the circumstances of your unemployment.

    Come January, your son may choose to finish his senior year with his friends and then move after graduation.

    It always takes a couple months for the child support order to take place and also to be modified. By the time everything gets changed, he might be 18 or close to 18. You always pay child support even if you are unemployed.
