17 Year Old Moving to Different State
My question involves juvenile law in the State of: Florida
Ok my best friend is 17 and she lives in Georgia. Her mother is a complete psycho, has threatened to kill her, and researched ways to abuse her without being penalized.
In Georgia it is legal for her to move out at the age of 17, but what i need to know is can she move to Florida where I live? I dont know Florida's "runaway" laws and/or what we need to do for it to be legal...
Re: 17 Year Old Moving to Different State
maybe you have some information I don't but from what I see, she is under her mothers control, in Georgia, until she is 18.
Quote:
§ 39-1-1. Age of legal majority; residence of persons in state for purpose of attending school
(a) The age of legal majority in this state is 18 years; until that age all persons are minors.
(b) Nothing in this Code section shall be construed automatically to render an individual a resident of this state when that individual is in the state for the purpose of attending school. In the case of such individual, his residence will be considered to be the state in which his parents reside if under the laws of that state the individual would still be considered a minor and he is incapable of proving his emancipation.
if she is living in unsafe conditions, she needs to contact child protective services.
Re: 17 Year Old Moving to Different State
Apparently not.
Quote:
the legal age of majority in Georgia is eighteen (18). Georgia Code Title 39, Chapter 1, Article 1.
A child (anyone under the age of 18) cannot just move out from their parent(s) home. The parent(s) are responsible for the child till that child reaches 18. You can leave your parents' house without their permission when you reach the age of 18, or they can kick you out.
You cannot leave before you reach 18, although there are a few exceptions.
Exceptions to this rule:
If a child gets pregnant, that child can get married without parental consent and after the marriage will be consider emancipated.
The teen can become emancipated. There is no prescribed emancipation status laws, such cases are adjudicated on an individual basis. This requires a ruling from a judge. You must convince the judge that there is good legal reason for you to be able to leave your home. In the state of Georgia on an annual basis this happens about a dozen times.
The teen can join the military with parental consent at age 17.
Anybody harboring an underage runaway can be prosecuted at the FEDERAL level.
Re: 17 Year Old Moving to Different State
We have asked a few lawyers, and know friends who have moved out at 17 and the police said neither they or the parents could do anything because they are viewed as adults in the eyes of the law...
But what we need to know is Florida's laws about moving out at 17....

Ah, no. They're viewed as adults when it comes to CRIMINAL court.
Not family court. It's a common mix-up though.

so, what law did they cite? I just cited the law that states she is minor and as such, under her parent's control until she is 18. That makes it a crime for her to run away.
for a person to be viewed as an adult in the eyes of the law, it must be backed up with statute. Unless you can find one to trump the one I gave you, your question is moot.
Re: 17 Year Old Moving to Different State
*Her mother has known for almost eight years but refuses to tell her where he is.
*And I have asked a lawyer and they agree that at 17 in the eyes of the law (and any court) they are viewed as an adult...
*Im not sure, I wasnt there. But this has happened countless times both with friends and relatives leaving.
Georgia law says that a minor of 17 can move out of her home, the parents are only required to give them one change of clothes though, and if said minor decides to return for any reason no matter how many times they leave the parents have to accept them back into the home until they are 18.
Re: 17 Year Old Moving to Different State
Please show me the law that says that the parents are REQUIRED to provide one single change of clothing, if their 17 year old moves out.
You seem to be mistaking the "at 17, juvenile court no longer has jurisdiction" thing.
