    Caught Shoplifting - What Do I Do
    My question involves criminal law for the state of: New York

    So I was feeling stupid on July first, and decided to steal a shirt at H&M. The shirt was $5 and i put it on, and I was stupid and was feeling too lazy to pay for it, so I put my shirt on top of it and walked out. I was stopped by one of the guys who worked there along with two cops. They brought me back into the store, and then brought me into the room with security cameras. They had me take the shirt off, and then gave me a ticket/summons. They told me i had to appear on court on that date. What I don't understand is that on the ticket, they put the reason as "Trespassing" and in Violation of penal law '140.05' which is trespassing. I don't understand why they put that. I am also currently going through the immigration process and cannot afford this because this might affect it. Can someone tell me what I should do ? I'm asked to come in on September 7 2012, but the cops were telling me i can probably go earlier, but iv also been told i can't go earlier and have to go on the date. Can someone please clear all this up for me? Thanks in advance

    You should hire a lawyer to represent you in court. You should also hire a lawyer to represent you in your immigration case. Immigrants need to stop this sense of entitlement to steal crap, when coming to the US, then crying because they are caught and will likely be kicked back out of the country.

    You go on whatever date the court summons tells you.

    "I am also currently going through the immigration process and cannot afford this because this might affect it." You should have thought of this before shoplifting a $5.00 t-shirt.

    They only wrote you up for Trespassing and you're complaining? They could have written you up for Retail Fraud, which looks a hell of a lot worse on paper.

    Get a lawyer, and mention the immigration issue to him/her.
