Can You Get Your Child Support Lowered

My question involves child support in the State of: My boyfriend has 2 children where he pays child support for. First he didn't get a notice that he had to go to court and attorney generals office went ahead and calculated that he was making $1500 more a month which he is not. They wanted him paying $960 a month, which is a $150 more. He appealed and he brought check stubs showing that he does not make that much. The reason showing is that, when his ex takes him to court he always has a shut down, to where he has overtime and makes money for that month. But they still didn't take his check stubs in account. Well my boyfriend and I just had a baby. They knocked off $96 for our baby, which put him at $850 a month. Well my boyfriend got a letter in the mail saying his payments starting at the beginning of the month is $850 mo. + $248 for Medicaid which puts at, at least $1100 a month giving his ex at least $250 a week. Attorney generals office says he is $1000 + behind in c.s. because with the change they took it back to April which is $90 difference a week and $360 a month more he has to pay on top of the the new change. My boyfriend works 36 hrs one week n 48hrs the nxt week, on the week he work 36 hrs he has a $350 check. How can we make it with the week he works 36 hrs if he gives his ex $250, what can we do with a $100 if there is 3 of us? His ex has 2 jobs n is filing child support on her 2 other children, she is living large, while we struggle to make ends meet and pay bills. We have to go weeks with out phones and we get behind on bills cause we dnt have money. What can he do?

Stop having kids you can't afford? Get a job yourself?

Seriously - you were lucky you got that much of a credit for your baby. Which state is this?

So? The ex is not doing anything wrong by invoking her children's rights to financial support from BOTH parents.

If your boyfriend is that broke, he had no business knocking you up. Does that sound mean? Probably. But those other two children were in existence first, and the court is not really going to care all that much about YOUR baby bell ringing.

(I'm thinking this is Texas, from "Attorney General". If it's Texas, it matters not what Mom earns anyway)

have your gf file for support from another state (if you trust her) giving her as much as she demands then take that court paper to the first court and get it lowered there. she can still live with you as well. you can then borrow money from her as a debt.

That, and this is what's known as "fraud".

its not fraud for a woman to protect her assets & besides the deduction for having a child in your home is a fraction to the support they make you pay for not. Its just making fair an unfair practice.

So as long as she's on the fence about her future with you, she can still live with you and collect child suport from you to which you can pay her any amount she dammands & that legal court paper will hold up in any court of law as a deduction grom gross income.
