When Can You Apply for Naturalization if Continuity of Residency is Broken
Hi! I've had my green card for almost 5 years now (it'll be 5 years in December). However, I'm going to France in a study abroad program with my university in January, and the program is supposed to end in July, which means I'd be abroad for 7 months. If I do so, can I still apply for citizenship in October 2013? If I can't, how long will I have to wait until I can apply for citizenship again?

A Permanent Resident who is going to be absent from the U.S. for more than six months can expect to be scrutinized upon reentry, and to have to overcome the presumption that they abandoned their permanent residency. They should thus be prepared to answer the Immigration Officer's questions about their absence, and should also be prepared to provide documentation explaining the absence and showing continuing ties to the United States (family ties, employment, property, employment, etc.). If you are concerned about the strength of your ties or documentation, you should consult an immigration lawyer.
