Landlord Forces Tenants to Use One Cable Provider
My question involves landlord-tenant law in the State of: California
I would like to know if it is legal for a landlord to force tenants to use only one cable provider. I moved into a one bedroom and didn't find out until after that the landlord does not allow the use of dish providers. Due to my location there is only one cable provider for my area. I previously had this carrier and would not choose to have them again. Can the landlord actually force me to have services with this provider even if there is no mention of this in my lease?
Re: Landlord Forces Tenants to Use One Provider
Are you able to install the dish exclusively within areas of your unit that you control - not in a common area, not in a manner that involves drilling holes in exterior walls, not in a way that overhangs a balcony in violation of a provision of your lease, etc.? If so, you likely have the right under FCC regulations to install the dish. The devil is in the details, so if you want more than that you'll have to share some.
Re: Landlord Forces Tenants to Use One Provider
Unfortunately I can't have the dish installed anywhere in the unit. I'm told it has to be on the outside where it can reach a signal. I don't have a private balcony so that is not an option either. The irritating part is that neither the manager or the lease mentioned this prior to my moving in. I would have selected another building if I had known. There is literally no other provider option open to me.
