    My question involves name change laws in the State of: Texas
    When my son was born his biological father did/was not put on the birth certificate. He has never tried to or wanted any part in my sons life My son is now 8 1/2yrs old. I am now married and my son has known my husband as his daddy since the age of 1 1/2yrs old. I do get child support because they take it out of the biological fathers checks. My son wants his last name changed to my married name so I am trying to figure out how to go about doing that so he doesnt feel like an outcast from the rest of the family can anyone help me here, Please!

    It will take a court action. The legal father will have to be notified and can certainly protest the change. Tons of children have different names than their mother and siblings without being outcasts (thank you very much, I have two step children of my own who have their biological father's name).

    You make a petition explaining why such a change would be in the CHILD'S (not yours or your husband's) best interest. You have to either have consent or show you have complied with the notification of the other parent (this has to be legal service) of the petition and the date/time/place of the hearing on the matter. You must file legal proof of this consent/notice prior to the hearing.
