Would I Be Charged for Sexual Assault

will give you the details of what actually happened :
after initial email and text exchanges she suggested a cafe for meeting. I have never been to that cafe before.
I had coffee and she had some cold drink. then we went outside and were walking and talking. At some point we were holding hands (it was mutual and consensual). She was holding my hand too ( i never forced or took charge). as we were walking, she suggested that there is a place near by in that park where we can get a nice view of the city and the freeway. I have never ever been to that place before. so we walked up there. and there was a place to sit. we sat there together and were just watching the city.
we were sitting close to each other. she was leaning against me. and leaned her head on my shoulders.
i didnt force her to do that.then we both had our arms over each other's shoulders. she was rubbing my shoulders.
she also said that it was great to sit there and watch the freeway and the city.

she was the one who first leaned in to kiss me.
then she got up and sat on my lap facing me and we were kissing and caressing.( she said " this position may not work, but she will work it out")
she was caressing my my gential area over my clothes. i was doing the same.
at no point i was over powering her. she was the one who was sitting on my lap.

at some point she stroked my penis a few times. i also touched her genital area. i had no intention to penetrate her.
i dont remember whether i kissed her genital area. i could have. but all the time she was holding on to my shoulder pressing me towards her. she even uttered "oh baby" when we were making out.

when we left. she got a call from her friend and she was talking in the phone and she hugged me good bye and we left.

the next day i texted her asking how she was. she abused me saying that i am dirty scum bag and i backed off feeling that she was bit psychotic.


What she claims:
* i was the one who forcibly took her to that spot. and i told her "we do it either the easy or hard way"

* i made her stroke my penis until i ejaculated. ( i never ejaculated. she was stroking it volunterly only for few times.)

* she also says that everytime she tried to push me away and reached for her phone (which she claims was ringing) I pushed her away and grabbed her phone and put it away.
( i never even touched her phone. i dont even know what model of phone she has. and i did not hear the phone ringing at any point of time)

* she claims that she ended up having a busted arm due to my intimidation. and her arm was put in a plaster cast for three weeks. and she claims having got few grazes and bruises.
( she was using her hands to talk on the phone and she was also searching for something in her bag etc. i am not sure if someone with a busted arm that had to be plastered for 3 weeks could do that)


my observations:
* the photos of her injuries submitted to the police look bit self inflicted.



These are the things that happened. I am totally innocent. I didnt have any malicious intentions. Please help me.

also she sent me few emails after couple of weeks after this incident asking as what i did to her on that evening ( it seemed as if she was trying get things out of my me as evidence). i just replied saying a generic sorry, because i wanted to move on from this psychotic girl.

now its been 4 weeks since the police contacted me for taking dna samples from me. i havent heard anything from them. i have consulted a lawyer. he says he still hasnt heard anything from the prosecutor or the police.
does it take very long to lay charges?
do i have a good chance to defend myself?

For the most part, this forum deals with US law only. There are one or two contributors who are familiar with some aspects of UK and/or European laws, but nothing coming close to your "situation".

...unless your story is fake...and I bet it is fake - given that the word "freeway" is not a word in Scotland. And "busted arm" - no such thing in Scotland! And what's with all those misplaced periods? The Scottish school system's 'way better than that!
