    Chapter 13 with Mortgage Payments Included
    Hello there. I am new to this website. I have a question. I am currently in a Chapter 13 modified plan to only pay 5% to non-secured debtors and 100% to secured debtors. My question is this: I have about $7000 in back mortgage payments on the Chapter 13 and I am seriously considering converting to a Chapter 7 and giving up the house. There are alot of things wrong with my home, and I do not have the means to fix all of them on my own. My credit is obviously bad so a home equity loan is out of the question to fix it. I tried to refinance, but I have not been in the Chapter 13 for the required 36 months for them to only pay off 5% of the total non-secured debtors and I would have to pay everyone 100%. My home was only appraised at $170,000 and I would not have enough cash out money to cover all of the bankruptcy. I can try again in July 2007, but I'm not sure if I want to. I need to know if when I convert to the Chapter 7 and they take the house will I still owe any money on the property? My mortgage is now $98,000. Wisconsin allows a homestead credit of $40,000 I think. What are my options?

    If I were you I would certainly discuss the possibility of converting the case to Chapter 7 with a bankruptcy lawyer.
