    How Much Visitation Will Be Ordered
    My question involves a child custody case from the State of: Virginia



    My question involves visitation setup. My daughter is 11 years old and I have had custody for 3years.
    I just received papers about a week ago to establish visitation. The other parent had moved to Colorado for about 2 years and has recently returned due to losing her job.
    There has been a documented history of physical and emotional abuse from the other parents boyfriend. My question is what type of visitation can be expected and how much weight does a therapists recommendation have thank you.

    Documented history as in, charges? Convictions? Child services confirmed?

    (There's a reason I'm asking)

    Cps Founded case of child abuse. This was a main reason custody changed.

    yes, she is. She has a newborn son and is planning on getting married soon.

    Okay. Given the circumstances, I would request only supervised visitation for Mom - at least temporarily. If that doesn't work, you can also request that the boyfriend is restrained from being around your daughter unattended; that would at least be better than nothing.

    What is the therapist going to testify to?

    Afterthought:

    I'd request the supervised visitation to take place in either a therapeutic setting or a neutral setting - at Mom's cost.

    As the change of custody three years ago was precipitated by the abuse charge, what did the court order for visitation at the time it issued its order? What visitation, if any, has occurred since mom moved?

    The therapist recommends supervised visitation and does not want the boyfriend around at all. The mother does not seem upset at what happened to my daughter. She feels it was discipline and that I over reated to the situtation. The therapist stated that the mother is like a puppet and he feels could pose a danger in protecting my daughter because of her passivness about the situation.

    Have the therapist testify on your behalf at the hearing.

    They didn't order anything. The judge stated that it was in my daughters intrest to live with me and not to be around the boyfriend. He said she could file visitation and also noted it would be in her visitation order that there was no contact with the boyfriend but that was 3 years ago. She never filed and moved to Colorado. She would never agree to not having the boyfriend around so she only did skyp or phone calls. When the mother moved though she stopped really trying to have a relationship wit our daughter. Our daughter would call and the mother would never return calls and go weeks without any type of contact. Currently we work around the boyfriend's work schedule. I just want to protect our child not take her away.
