Stolen Property Found During a Traffic Stop
My question involves criminal law for the state of: Kentucky
About 5 days ago me n my bf were stopped by a police officer. The police officer smelled weed and began searching the car which is when he found items that had been reported stolen(things like iPhones,etc. They arrested my bf on 4 charges 1 felony which was recieving stolen property. The cops let me go and did not arrest me or say I was in any trouble at all! Even though the items were in my car. My bf told the officers that everything(the drugs & stolen items) were his and I had nothing to do with it. But now the police are saying they need me to come down and talk with them and that if I don't I'll be in trouble. They also told my mother I was wanted for a line up and they could charge me with everything my bf is being charged with If I don't come down and tell them the truth. However the police officer then said if I just come down and am honest with him they will let me walk right out. I don't understand why they let me go and now are acting like I'm in trouble? Are they just trying to scare me so I'll make a statement against my bf? Could I really be wanted for a line up? Do you think they have a warrant for me? I'm scared and I don't know what to do.

if you are in trouble if you don't go and speak to them, you are already in trouble.
Given the situation, I would simply refuse to speak with them without the counsel of a lawyer first. Tell them if they insist on speaking with you, you have to consult legal counsel first and you will contact them after you have done so. If they arrest you, do not say anything without a lawyer present.
You can't talk your way out of trouble but you can surely talk your way into trouble.

Since your boyfriend made statements that he was fully at fault, the cops probably didn't have enough probable cause to arrest you on the spot. However, that does not mean that the investigation ends at that point. Further investigation might reveal further evidence of your culpability. This would put you again under suspicion. Now, the police want to talk to you...to either confirm their suspicions or find your explanations for whatever has raised those suspicions.

Possibly. If they think that you have knowledge of your boyfriends' crimes, they may want that information. They may want information from you (that you may not even know is important) about possible accomplices of your boyfriend. Maybe your boyfriend has given you as an alibi for other crimes they may now suspect him of and want to question you to either confirm or refute that. In other words, nobody but the cops know WHY the cops want to talk to you again.
The bottom line is that you are a close companion of (in the opinion of the police) a druggy and thief. Whether you like it or not, your reputation is affected by that association. So, the investigating officer(s) are not going to view you in very high regard.

Sure you could. You are a known associate of a person strongly suspected of crimes. If there were witnesses to these crimes who reported a female accomplice, they could pick you out of the lineup.

If they had a warrant, they wouldn't be talking to you on the phone and asking you to come in. They would come pick you up, take you away in handcuffs, and provide a police escort to the place of your interview.

Okay that's what I believe is going on too. I believe they just want to get information out of me or have me come down and incriminate myself or my bf. My bf has been in jail for 5 days and I haven't been up to visit him cause I'm scared they will pick me up. I want to go see him so bad but I don't know if that's the smartest thing to do right now. If the cops don't have a warrant do you think it would still be a bad idea to go see him? Could they do anything to me without a warrant? Can they make me go through with the line up without a warrant?

One last question.
Ive been able to talk with my bf a few times since he has been in jail. However I haven't been able to explain anything to him or let him know that I may be in trouble too. I'm afraid to say anything over the phone that may incriminate either of us. Can anyone give me advice on what not to say or talk about?
He doesn't understand why I haven't been up to see him and he thinks I am not in any trouble because last he saw the police let me go when he told them everything was his. Could I tell him over the phone that the cops want me to come in and they want to talk with me? And that they said I'd be in trouble of I didn't? Or is that to much info to give over a jail phone?

Been in trouble so I'm not sure how any of this works.
