    Speeding Ticket in Whitman County
    My question involves a traffic ticket from the state of: Washington, County of whitman.

    Let me first off thank you for taking the time to help me. I got a speeding ticket in Whitman County on 05/01, The Court Received my response to Contest the ticket on 05/15. Today in the mail I received my court date, And it was dated 05/31 but did not send in the mail till 06/06! The date of my Court schedule is 06/13. Didn't the court break the 14 day rule? Also this is my first (alleged) traffic infraction, so I do qualify for a deferral, I would just rather not use it.

    What should my next step be, I have not filed for the Discovery yet.

    It seems Whitman County is really bad at this. I've seen it 3 times in 3 months now. Call the court and request a continuance on or after the 20th of July. That should give you plenty of time. You may need to overnight them a continuance.

    Unfortunately, no, they did not break the rule in IRLJ 2.6.

    Woah. Wait. How do you know they didn't send the notice until 6/6? You mean you didn't receive it until 6/6, correct?

    Thank you for taking the time to respond.

    I included, above, the picture on the envelope of when it was time stamped with the postal stamp. The letter was sent from the court house 6/6 and i received it today, 6/7.

    I see. Okay. Well, now that you have proof that it wasn't mailed until the 6th, you've got yourself a 2.6(a) argument.

    All you need to do is file a motion for a speedy hearing with the court.

    It sounds counterintuitive, but it's required by IRLJ 2.6(d). Read through that, and serve upon the prosecutor and file with the court your motion - BEFORE wednesday!

    I was able to send off the Motion for a speedy hearing to both the prosecutors office and the court this morning. It should arrive sometime tomorrow. What would be my next step? I have court on Wednesday afternoon.
