Biological Father Visitations
My question involves a child custody case from the State of: Arizona
I am recently going through a divorce and I have two kids and a step child. The mother took off on all of us and I continued to take care of my kids. She came back after I filed for divorce and emergency custody. We have been to court and waiting until the final hearing to finalize it.
I still have custody over my two and my step. I have been in her life for the past 7 of 8 years and I'm all that she knows as "daddy." Her biological father has maybe seen her 5x in the past 3 years and has been in jail 8x in the past three years. Now that he knows that I have custody is is trying to make an appearance in her life again. I talked to my lawyer and the she informed me that the parenting time that he had set up is not "valid" since it's between him and the ex. Since I only have temporary sole custody until the finalization of the divorce, can he still file paperwork with the courts to start a new parenting time with me? Will that change should the custody get changed?
He has already called the cops on me for parental interference and they were even at a lost when I told them the story and the court rulings and that his parenting time is "invalid" So, no charges were brought up due to there not being a "current parenting plan."

Actually, he has a chance to get more than visitation, he could get custody.

Wait - there is ALREADY a parenting plan involving HIM and the ex?
